Question:

What is the ruling on someone who cursed the Messenger (may Allah bless him and grant him peace), swore at him, and cursed the Lord Almighty, and has not repented to this day? This occurred in front of us and a large gathering of people of knowledge and faith.

His wife informed us that this is not the first time; rather, she says he continually dares to utter such curses. Today, she wants to know whether, according to Sharia, she is still considered his wife, or if their marriage has ended following this apostasy?

For your information, the husband does not pray at all, and he works in singing and music at weddings and mixed parties. What is your advice for this poor wife? We ask the Almighty to reward you and keep you as a treasure and a light for Muslims worldwide. And peace be upon you, and the mercy of Allah and His blessings.

Answer:

Cursing Allah the Almighty is major disbelief and apostasy from Islam if the person cursing ascribes themselves to Islam. The same applies to cursing the Messenger (may Allah bless him and grant him peace) by the consensus of the people of knowledge (scholars).

Likewise, abandoning prayer is major disbelief, even if he does not deny its obligation, according to the more correct of the two scholarly opinions. The mandatory course of action is to refer his case to the Sharia court.

As for the wife, she must refrain from allowing him access to herself [marital relations] if she knows what you have mentioned, until his case is resolved by the court.
